Acceptable Use Policy
1. Purpose
This Acceptable Use Policy ("Policy") governs the acceptable use of the ThinkKits platform, including its web application, API, data services, and all related tools and features (collectively, the "Platform"). By accessing or using the Platform, you agree to comply with this Policy. Violations may result in suspension or termination of your account.
2. Scope
This Policy applies to all users of the ThinkKits Platform, including:
- Explorer (Free) tier — users with limited daily lookups and saved items
- Starter, Professional, and Business tiers — paid subscribers with expanded access
- API consumers — developers and applications integrating with the ThinkKits API
Organizational administrators are responsible for ensuring that all users under their account comply with this Policy.
3. Permitted Uses
The Platform is intended for legitimate education-sector use. Permitted uses include:
- Education market research and competitive analysis
- School and district data analysis for planning and decision-making
- Federal and state funding identification and eligibility assessment
- Grant writing support and justification report generation
- Curriculum and materials planning aligned to standards
- Vendor intelligence and lead qualification for education products and services
- Equity analysis and resource gap identification
4. Prohibited Uses
You may not use the Platform for any of the following:
- Scraping or bulk extraction: Using automated tools, bots, scrapers, or crawlers to extract data beyond the documented API rate limits or intended use of the web interface.
- Reselling or redistribution: Reselling raw data, redistributing reports, or sublicensing Platform content to third parties without a written license from ThinkKits.
- Discrimination: Using data to discriminate against schools, students, or communities on the basis of race, ethnicity, socioeconomic status, disability, or other protected characteristics.
- Reverse engineering: Attempting to reverse engineer, decompile, or extract AI features, algorithms, or proprietary logic from the Platform.
- Credential sharing: Sharing account credentials, API keys, or access tokens with unauthorized parties.
- Non-education commercial use: Using the Platform for commercial purposes outside the education sector without written consent from ThinkKits.
- Tier circumvention: Attempting to access data, features, or API endpoints beyond your subscription tier.
- Malicious activity: Uploading malicious content, attempting to compromise platform security, or engaging in denial-of-service or similar attacks.
5. Data Usage & Privacy
Users must comply with applicable data protection and privacy laws when using school and student-related data accessed through ThinkKits. This includes:
- FERPA: The Family Educational Rights and Privacy Act — do not use Platform data to identify or target individual students or to access protected education records.
- COPPA: The Children's Online Privacy Protection Act — do not collect or use personal information from children under 13 through the Platform.
- State privacy laws: Comply with state-specific student data privacy laws (e.g., SOPIPA, state student data laws) where applicable.
Data accessed through ThinkKits is for professional use only. Do not use it for personal, non-professional, or unauthorized purposes.
6. API Usage
API rate limits apply per subscription tier. Exceeding these limits may result in throttling or temporary suspension of API access.
- Starter: 1,000 API calls per day
- Professional: 100 API calls per day
- Business: Unlimited API calls per day
- Enterprise: Custom limits available — contact sales for negotiated terms
API consumers must implement reasonable backoff and retry logic. Abuse of the API (e.g., sustained high-volume requests, bypassing rate limits) is prohibited.
7. Account Responsibilities
You are responsible for all activity under your account, including activity by users to whom you have granted access. You must:
- Maintain the confidentiality of your credentials and API keys
- Notify ThinkKits immediately of any unauthorized access or suspected breach
- Ensure that your use of the Platform does not violate any applicable laws or third-party rights
8. Enforcement
ThinkKits reserves the right to investigate suspected violations of this Policy. Violations may result in:
- Warning: A written notice requiring corrective action
- Suspension: Temporary restriction of access until the violation is resolved
- Termination: Permanent termination of your account and access to the Platform
No refunds will be issued for accounts terminated due to Policy violations. ThinkKits may report illegal activity to law enforcement and cooperate with investigations.
9. Modifications
ThinkKits reserves the right to update this Policy at any time. Material changes will be communicated with at least 30 days' notice via email or in-app notification. Continued use of the Platform after the effective date of changes constitutes acceptance of the updated Policy.
