By accessing or using the ThinkKits platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to all visitors, users, and others who access the Service.
ThinkKits provides an education data intelligence platform that aggregates publicly available school, district, and funding data to help educators, administrators, and education vendors make informed decisions. The Service includes data dashboards, funding tools, standards alignment features, and related SaaS capabilities.
You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or your organization. By using the Service, you represent that you meet these requirements.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify ThinkKits immediately of any unauthorized use. ThinkKits reserves the right to suspend or terminate accounts that violate these Terms.
You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to gain unauthorized access to any part of the Service or its infrastructure; (c) scrape, harvest, or systematically download data beyond normal platform use; (d) reverse-engineer or decompile any part of the Service; (e) use the Service to transmit spam, malware, or harmful content; or (f) resell or sublicense access to the Service without written permission.
ThinkKits indexes publicly available education data from sources including NCES, the U.S. Department of Education, and state education agencies. We do not collect personal information from students under 13. Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
All content, features, and functionality of the Service — including software, text, graphics, logos, and data compilations — are owned by ThinkKits LLC and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.
Paid plans are billed on a recurring basis (monthly or annually) as selected at signup. All fees are non-refundable except as required by law or as described in our refund policy. ThinkKits reserves the right to change pricing with 30 days' notice. Failure to pay may result in suspension or termination of your account.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. THINKKITS DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. DATA PRESENTED ON THE PLATFORM IS SOURCED FROM PUBLIC RECORDS AND MAY NOT REFLECT THE MOST CURRENT INFORMATION.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THINKKITS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO THINKKITS IN THE 12 MONTHS PRECEDING THE CLAIM.
ThinkKits may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will survive, including ownership, warranty disclaimers, and limitations of liability.
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Montgomery County, Pennsylvania.
ThinkKits reserves the right to update these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page with a revised effective date. Continued use of the Service after changes constitutes acceptance of the new Terms.
